Onezee Terms of Service
Welcome to the Onezee platform (the "Platform"). By using the Platform, you ("User") agree to these Terms of Service ("Terms"). Please read them carefully as they outline your rights and responsibilities when using our services.
- Platform Overview
- The Platform allows streamers to collaborate with advertisers and earn sponsorships through campaigns integrated into their streams. By using the Platform, you enter into a legally binding agreement with Onezee.
- We comply with all applicable data protection regulations, including the General Data Protection Regulation (GDPR) in the European Union, to ensure that your personal information is safeguarded throughout your use of the Platform.
- Eligibility and Account Creation
- The Platform is available to users aged 13 or older. If you are between 13 and 18, you must review these Terms with a parent or guardian. For jurisdictions requiring age verification (such as COPPA in the United States), you must confirm your eligibility to create an account on the Platform.
- To use the Platform, you need an account on interactive livestreaming platform, OBS – based software, and an updated web browser with JavaScript and cookies enabled. For more detailed technical requirements, please refer to Annex 1.
- You are responsible for the accuracy of the information in your account and for keeping your password secure. For more details on account management and security obligations, please refer to Annex 1.
- All data stored on the Platform are encrypted and we regularly perform security audits to ensure the integrity of your account and personal data.
- Monetization and Campaigns
- Users can participate in advertising campaigns to monetize their streams. Earnings are calculated based on the model indicated in the campaign, e.g. CPC (Cost Per Click) or CPM (Cost Per Mille). For more information on campaign participation, ad placement, and payment processes, see Annex 1.
- Users are responsible for complying with all applicable tax laws in their jurisdiction regarding any income earned through the Platform. Onezee is not responsible for providing tax advice but will offer summaries of earnings to assist with your tax reporting.
- Content and Responsibility
- You are responsible for all content you share on the Platform, ensuring that you own the rights to that content and that it does not violate third-party rights or laws. The Platform reserves the right to monitor, edit, or remove content that violates these Terms or the law. For detailed content guidelines, refer to Annex 1.
- If your content is removed or modified by Onezee due to a breach of these Terms, you will be notified of the reasons for removal. You may appeal this decision by following the appeal process outlined in Annex 1. Appeals will be reviewed by a combination of automated systems and human moderators.
- Prohibited Activities
Users may not:
- Violate any laws or regulations while using the Platform.
- Engage in spamming, phishing, or other harmful activities.
- Interfere with the Platform’s operations or security features.
- Use automated systems (e.g., bots) to manipulate the Platform.
In accordance with various cybersecurity regulations, any attempt to breach platform security will be met with legal consequences.

- Intellectual Property
- All materials on the Platform, including text, software, and trademarks, are owned by Onezee or its partners. You may not reproduce, modify, or distribute these materials without prior written consent. For detailed intellectual property restrictions, refer to Annex 1.
- Account Termination
- We may suspend or terminate your account for violations of these Terms or if required by law. You may also close your account at any time.
- Upon termination, all user data will be deleted in compliance with global privacy standards. In certain jurisdictions, we may retain specific records for legal or regulatory reasons (e.g., tax reporting).

- Liability
- Onezee's liability to Users is limited to the amount of revenue earned on the Platform. We are not responsible for technical issues or events outside our control. For more details on liability limitations and dispute resolution processes, please see Annex 1.
- Complaints and dispute resolution
- If a service is not working properly, or You want to make any other complaint, You can inform us, please see Annex 1.
- Disputes arising from the use of the Platform will be governed by the laws of Poland. For users residing in jurisdictions with specific dispute resolution laws (e.g., United States or Brazil), local laws may provide for alternative dispute resolution mechanisms, such as arbitration. For EU residents, we provide access to Online Dispute Resolution (ODR) as required by EU regulations, please see Annex 1.
- Privacy and Data Protection
- Your personal data is processed in accordance with our Privacy Policy. The Platform complies with all applicable data protection laws, including the GDPR. We ensure that data is handled securely and in compliance with any applicable cross-border data transfer requirements. For users outside the EEA, Onezee applies Standard Contractual Clauses (SCCs) or other equivalent safeguards where required.

- Changes to These Terms
- We may update these Terms at any time. Continued use of the Platform after changes are made indicates your acceptance of the updated Terms. You will be notified of any material changes.

- Detailed Terms of Platform Use
- Annex 1 of these Terms of Service is the document titled "Detailed Terms of Platform Use," which provides specific guidelines and technical requirements for using the Onezee platform. This document, together with these Terms of Service and our Privacy Policy, constitutes the complete and comprehensive set of rules governing your use of the Platform.
- By agreeing to the Terms of Service, you also agree to be bound by the provisions set forth in the "Detailed Terms of Platform Use." In the event of any discrepancies between the documents, the Terms of Service shall prevail, unless otherwise indicated.
Annex 1 – Detailed Terms of Platform Use
- Technical Requirements
- To effectively use the Onezee platform, users must ensure their system meets the following minimum technical requirements:
- Web Browsers: Mozilla Firefox (latest 3 versions), Google Chrome (latest 3 versions), Safari (latest 3 versions), Opera (latest 3 versions), all with JavaScript and cookies enabled.
- Software: Open Broadcaster Software or OBS - based software is required for streaming.
- Internet Connection: A stable internet connection is necessary for uninterrupted use of the Platform.
- Account on interactive live streaming platform: Twitch.
- We strongly encourage users to regularly update their web browsers and software to ensure compatibility with future platform updates.
- Account Management and Security
- Users must provide accurate and complete information when creating their accounts and are responsible for securing their login credentials.
- You may not create multiple accounts or share your account with others without explicit permission.
- Users must immediately notify Onezee in case of any security breach or unauthorized use of their account.
- Campaign Participation and Monetization
- Campaign Participation:
- Users may apply for campaigns or be automatically matched with advertisers based on the type of content they produce. Advertisements are integrated into streams, and users must use the Platform’s tools to ensure proper disclosure of sponsored content to their audience.
- Users must accept the terms and conditions of a particular campaign in order to participate in it. In case the terms and conditions of a particular campaign deviates from this Onezee Terms of Service, the terms and conditions of a particular campaign prevail.
- By participating in a campaign, the user grants Onezee the right to use excerpts from streams containing advertisements delivered within the framework of the campaign for Onezee's advertising purposes.
- Earnings: Earnings are calculated based on the model indicated in the campaign, e.g. CPC (Cost Per Click) or CPM (Cost Per Mille). The payment model for a particular campaign will be specified in the terms and conditions for that campaign.
- Payment: Users can request a payout once their account balance reaches €50. Payments will be processed within 45 days of the request.
- If necessary, Onezee can also change the campaign settings during the course of the campaign. Users will be notified in advance by email.
- Onezee sends all communications regarding the Platform, account or campaign to the user via email.
- Users are responsible for ensuring that they comply with the tax laws in their jurisdiction, including the reporting and payment of taxes related to income earned through the Platform.
- Campaign Participation:
- Content Guidelines
- Users are responsible for ensuring that their content does not infringe upon third-party rights or violate laws.
- Prohibited content includes, but is not limited to, offensive language, illegal material, threats, or content that promotes violence, hate, or discrimination.
- If the content displayed by the user violates the guidelines or disrupts the platform, Onezee reserves the right to remove the user from the campaign and to withhold any pending payments.
- If user is removed from a campaign or their payments are withold or their account is suspended or terminated due to content, they will be notified of the reasons for this decision. You have the right to appeal this decision by submitting a request through our appeal process, which will be reviewed by a combination of automated systems and human moderators. Appeals will be processed within 14 days.
- Prohibited Activities
- Users are prohibited from engaging in the following activities while using the Platform:
- Misuse of Account: Creating duplicate or fake accounts.
- Content Manipulation: Using bots, scripts, or other methods to generate artificial impressions (e.g. tools to generate ‘fake views’, streaming of static images) or manipulate Platform functionality. It is also forbidden to share content without “human participation”.
- Campaign Manipulation: Manipulating the frequency of campaign displays or interfering with the ads displayed within the campaign.
- Inappropriate Content: Posting content that infringes on intellectual property rights or violates community standards, such as hate speech or violent material.
- Security Violations: Attempting to bypass or interfere with the Platform’s security features.
- Users who violate these prohibitions may face immediate suspension or termination of their account and withhold any pending payments, without prior notice, depending on the severity of the violation.
- Intellectual Property Restrictions
- Users may not reproduce, distribute, or create derivative works from any materials provided by Onezee or its partners without explicit written permission.
- Users may not sublicense, sell, or otherwise share access to the Platform or its services with third parties without consent.
- Account Termination and Suspension
- By Onezee: We reserve the right to suspend or terminate user accounts for violations of the Terms. Affected users will be informed of the decision, including the reason for suspension or termination, along with instructions for appealing the decision.
- By Users: Users may terminate their accounts at any time. Upon termination, all data associated with the account will be deleted, and users waive any claims against Onezee related to account closure.
- Liability
- Onezee’s liability is limited to the revenue generated by the user on the Platform. Onezee is not responsible for:
- Technical Issues: Any problems related to the user’s equipment or network that affect the user's ability to access or use the Platform.
- Force Majeure: Events outside Onezee’s control, such as natural disasters, that affect the availability of the Platform.
- Non-recoverable Damages: Onezee is not liable for lost profits, lost data, or any indirect, incidental, consequential, or punitive damages, except where such liability cannot be excluded under applicable law.
- Onezee’s liability is limited to the revenue generated by the user on the Platform. Onezee is not responsible for:
- Complaints and dispute resolution
- If service is not working properly, or You want to make any other complaint, You can inform us:
- by email to admin[at]onezee.io;
- in writing, by mail sent to our mailing address (see Section 11 below);
- Your complaint should include a detailed description of the reason for the complaint, and any contact data necessary for Onezee to send You information on the outcome of the complaint. We will respond to the complaint within 14 days after we receive it. We will send the response through the same channel by which we received your complaint, unless You have specified another way of responding. We may ask you to provide additional information if it is necessary for our investigation of the complaint.
- Disputes arising from the use of the Platform will be governed by Polish law. Users residing in other EU countries may invoke consumer protection laws from their respective jurisdictions.
- In case of a dispute, users may opt to use an Alternative Dispute Resolution (ADR) process or an Online Dispute Resolution (ODR -https://ec.europa.eu/consumers/odr/main/index.cfm?event=main.home.chooseLanguage) platform, in line with European Union regulations.
- If service is not working properly, or You want to make any other complaint, You can inform us:
- Data privacy
- Onezee processes users’ personal data in accordance with applicable data protection laws, including the GDPR. For more information, please refer to our Privacy Policy.
- Users have the right to access, correct, or request the deletion of their personal data at any time by contacting Onezee.
- Glossary of Terms and Definitions
- CPC (Cost Per Click): A payment model where content creators are compensated based on the number of times visitors click on a display ad attached to their content. The amount earned depends on the cost per click rate, the number of clicks generated, and the terms specified in the campaign agreement.
- CPM (Cost Per Mille): A payment model where content creators are compensated based on 1,000 valid ad impressions displayed alongside their content. The amount earned is determined by the rate per 1,000 impressions and the terms specified in the campaign agreement.
- Content: Any text, images, videos, or other material uploaded, streamed, or otherwise shared by users on the Platform.
- Force Majeure: Unforeseeable events beyond Onezee's control, including but not limited to natural disasters, wars, or technical failures affecting the availability of the Platform.
- Impressions: The number of times an advertisement is viewed by unique users.
- OBS based software: Open-source software used for streaming content.
- Onezee: Spheric Capital sp. z o.o., ul. Karola Dickensa 27 / 51, 00-382 Warszawa, VAT ID: 7011091895. The service provider that operates the platform available at onezee.io.
- Platform: Refers to the Onezee website and its related services, including all features and tools offered by Onezee.
- Services: The services provided in accordance with these Terms, which consist of providing streamers with the opportunity to engage with advertisers and obtain sponsorship through the Platform.
- The terms and conditions of a particular campaign: The legal agreement between Onezee and the user that specifies the payment model, campaign duration, and specific parameters for the campaign.
- User: Any individual or entity that accesses or uses the Onezee platform.
